This Privacy Policy (the “Privacy Policy”) provides detailed information about how Davila Simon Group, S.L. (hereinafter “We” “Us” or “DSG”) uses and protect Customers and Members or users personal data (jointly referred as to “You”) when You are using our Landscape Website (hereinafter “Website” or “Site”), mobile app and our platform (the “Platform” or “Landscape”).

The Platform allows to create, participate and take part of a Landscape Community (the “Community”) in which its Members can connect, sharing with one another, messages, videos, images, links and content. Therefore, the Platform provides a technology that allows to collect, exchange, storage and analyze information from your organization all around the concept of Landscape (hereinafter the “Services”).

The terms governing your use of the Platform or Services are defined in our Customer Terms & Conditions (the “Customer Terms and Conditions”) and in our User Terms and Conditions (the “User Terms and Conditions”), jointly referred as to “Terms”.

Additionally, Customers are responsible for the collection and use of any data that Members submits or provides through the Community and such use is governed by our Terms.

Any capitalized term used but not defined in this Policy shall have the meaning given to them in the Terms and Conditions.

The processing of Personal Data by DSG is subject to the Regulation UE 2016/679 General of Protection of Data, dated April 27th, 2016 (hereinafter “GDPR”), and the Spanish Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights, dated on December 5th, 2019 (hereinafter “LOPDGDD”).

We are processing personal data in accordance with the following principles:

  • We only process personal data limited to the purpose for which it was collected.

Only in those cases when Customer subscribes either to Landscape Premium or Landscape Business: Bank details To comply with legal requirements, such us prevention of money laundering, tax and labor obligations. For compliance with a legal obligation to which we are subject (article 6.1.c) of the GDPR).

Additionally, You will be able to upload a profile picture and your job title but under your own responsibility as we do not need it for the purposes abovementioned.

We will not share your personal data with any third-party unless We are under a duty to disclose or share your personal data in order to comply with any legal obligation.

You have the right to request from DSG access to and rectification or erasure of your personal data or restriction of processing or to object to processing as well as the right to data portability.

transfer of personal data to other countries

If We need to transfer your personal data to other countries, We will transfer it only to countries where European Commission has decided that the country in question ensures an adequate level of protection, or with appropriate safeguards, like the signature of contract with standard data protection clauses adopted by the European Commission.

We use Amazon Database Service, a distributed relational database service by Amazon Web Services (AWS). Through AWS services, we are able to manage and storage the database of personal data regarding of Users.

data retention period

We will retain your personal data as long as necessary to render the Landscape and/or to comply with our legal obligations.

If You decide to stop using our service, no more of your information will be stored in the system unless we are legally allowed or required to maintain certain personal data for example, if there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute we will retain the necessary personal data until the issue is resolved.

We take all reasonable technical and organizational precautions to protect your personal data. Therefore, We implement the following technical and organizational security measures:

  1. We only collect Your nickname and email address as necessary to provide You our Services.
  2. Users and Customers have a password to access the Platform. We recommend that You regularly change your password. The password must contain at least one upper case letter, at least one lower case letter, and at least one number.

In the collection and processing of personal data, adequate security measures have been taken to prevent loss, unauthorised access or manipulation, in accordance with, in accordance with GDPR.
