Welcome to the Landscape Monitor software. We appreciate you using our services to manage your organization. We remind you that your use of these services is subject to your agreement with these Terms and Conditions. Here, we describe the relationship that governs the use of our services.

The Terms and Conditions are a binding contract between you and us. It includes this document as well as our Privacy Policy and Cookies Policy. Specific services may require additional terms and conditions. If you do not agree with these terms, you cannot access our services. When you register and use our services you have to accept this binding contract.

The Landscape Monitor and its associated website www.landscapemonitor.io provides services for a community to generate, share, and exchange information.

As the Landscape Monitor software changes keeping the Users’ interest in mind, we may update these Terms and Conditions to keep up with new features and legislation. We advise you to periodically review these Terms and Conditions to be informed about changes and their effective date. If the law requires your explicit consent, we will ask you for it. Otherwise, your continued used of the software will mean that you agree and consent to these changes. If you disagree with the changes and you do not want to operate within the updated Terms and Conditions, you will need to stop using the service. Yet, we will always maintain our commitment to respecting your privacy.

Our services provide a software platform for collecting, exchanging and analyzing information from a closed community established around the concept of a landscape.

Users and Costumers

A person is considered a User of the “Landscape Monitor” website when accessing or using the website and by the very act of accessing or using the site, accepts the General Terms and Conditions of Use listed herein. Users are typically invited to join a Landscape. These General Terms and Conditions apply regardless of the specific Contract Terms enforceable in each particular case. Customers are individuals or the organization that the individual represents who contract and pay for the service. Typically, a customer will set up a landscape, be its first manager, and invite Users to it.

As User, you are responsible for the accuracy and confidentiality of your account information as well as the activities that happen under your account; including those of others to whom you have given your account information. If you believe that somebody has been accessing your account without your authorization, other than our people for the reasons detailed in these Terms and Conditions, change your password and inform Customer Support at support@landscapemonitor.io

We grant you a non-sublicensable, non-transferable, non-exclusive license to use software solely as necessary to use the services as defined. The term of the license lasts until the expiration of the paid subscription; for free services the term is until terminated. Unless otherwise stated, subscriptions are automatically renewed for the same period as the current subscription. You can choose to stop automatic renewal.

Use of the Website

Once you create an account, we grant you a limited, non-exclusive license to use the services within the boundaries of these Terms and Conditions until you close your account or we do so according to these Terms and Conditions.

We keep the rights to implement new features in our services, including changes that may modify the mode of operation. We automatically update our software to improve and enhance our service. We also reserve the right to limit the amount of storage, number of transmissions, or the size of any element of the service with or without notice. While we are committed to the best level of service quality, we cannot guarantee that you will have access at all times to the service. You acknowledge that we are not responsible for impaired or lack of access during certain periods. We have no responsibility or liability as a result of any of these events including the deletion of part of your content.

Components on the Landscape Monitor website (including, without exclusion, navigation architecture, databases, services, graphics, videos and other content and/or visual components that make up the site) belong to DSG and/or third parties who have assigned their rights to DSG. DSG keeps the rights to the services including designs, trademarks, patents, and copyrights. You agree not to modify or create derivative products or decompile the source code of any Landscape software, unless expressly permitted. The User assumes responsibility for the use of the Website. This responsibility extends to the registration that may be necessary to access certain services or content. The User is responsible for filling in this registration form with true and lawful information. As a result of this registration, the User may be provided with a password for which he/she will be responsible, pledging to use it diligently and in confidentially.

You as a Customer (or your company if the company is the customer) owns the content posted on your landscapes and retain the copyrights and other rights of the content that posted in the services. But you grant us a royalty-free, worldwide, and irrevocable (as long as you use our services) limited license to make your content accessible and usable to the service and third party providers required for the service. You also grant us right to use, process, copy, distribute, export and display your content in order to (1) maintain, provide and improve the service, (2) address service, security and support, (3) as law requires, and (4) elaborate aggregate statistics and trends. We do not assume any responsibility for the actions of these third parties. You also grant us the right to modify your content for technical reasons. Beyond this limited license we do not have any other right to your content. In granting us this license, you warrant us that you have the legal rights and authority to submit the content. We retain the right not to display or communicate any content to our sole discretion. Because you are responsible for your content, we do not guarantee the accuracy, veracity or validity of the content in the service.

The User agrees to make proper use of the content and services that DSG offers through its Website, in accordance with these Terms and Conditions, including but not limited to refraining from engaging in activities which are unlawful, illegal or contrary to good faith and public order. In using the service, you agree to maintain a respectful language and attitude in all communications with other users. You are the sole responsible for the content that is uploaded from this person’s account. You agree to hold DSG harmless from and against liability, damages, losses, expenses, and claims derived from your use of the service. The service is available “as is,” the use of the service are at your sole risk. We do not warrant that the service will meet all your needs, will be uninterrupted, or will be error free. Materials downloaded or obtained through the service are at your own risk. Opinions and information obtained from the services create no endorsement or warranty from us.

In any case, DSG is not liable for any loss or damage because of the fraudulent use made through the User’s account. We are not responsible for the content or for your use of the service.

You are encouraged to submit your feedback and ideas to improve our software. We love feedback on how to keep on offering a better service. When you do so, you acknowledge that your contribution has no confidential information, and we are under no obligation of confidentiality and we can use or disclose your contribution, we may have a similar idea already on the way, and you are not entitled to any compensation or reimbursement of any kind. In providing feedback you grant us an unlimited, royalty-free, irrevocable, and perpetual license to use your feedback, ideas, and suggestions. We carefully read all feedback, don’t take it personally if we do not implement it yet.

Payment Obligations

Fees for our services are specified in our pricing page. Services must be paid in advance. Payments are non-cancelable and non-refundable unless expressly stated. Prices are exclusive of any taxes, duties, or any government assessment, unless otherwise stated. If fees are overdue for more than 30 days, we may downgrade the service to a free service plan until fees are paid. You acknowledge and agree that the downgrade will result in losing access to certain features and data

Industrial and Intellectual Property

All the contents, names, brands and databases accessible through the website are subject to industrial and intellectual property law of DSG or third parties.

Under no circumstances does access to the Website imply any authorization, waiver, transfer, license or assignment of all or part of such rights by their owners, unless expressly provided otherwise. These Terms and Conditions for the Website do not in any way give Users any right to use, modify, exploit, reproduce, distribute or publicly broadcast of the Website and/or its contents other than expressly provided herein. Any other use or exploitation of any rights will be subject to the prior and express authorization specifically granted for that purpose by DSG and/or third-party owners of the rights.

The use of the Website contents and rights is strictly prohibited for commercial or for-profit purposes, as well as their total or partial reproduction, communication and/or distribution, and their modification, alteration, decompilation and/or any other use of the Website, their pages and/or the contents they include. These actions may lead DSG to exercise any and all legal rights it may have through the courts or any other means.

You grant us the right to use your company’s name and logo for marketing and/or promotional purposes on our website and our communications. You can email us stating that you do not want to be used as a reference.

Applicable Law

The relationship between DSG, S. L. and the User shall be governed by applicable Spanish legislation.

Privacy policy

We believe in maintaining the privacy of your personal information and the content that you share with your community using the Landscape Monitor. Confidentiality and security are important values for us. We are also committed to asking only for the information that is required to deliver our services to their potential. This Privacy Policy note describes what information we collect, how we handle it, and which choices you have. Reading it will help you understand these important aspects.

When we talk about “we,” we are referring to DSG S.A. as the company that provides these services. “Services” refers to the software tools and platforms associated with the concept of the Landscape Monitor for collecting, sharing and analyzing information. These services are available currently through a web browser or web app.

In accordance with Law 15/1999 on Personal Data Protection, and Royal Decree 1720/2007 implementation of the Personal Data Protection Act, we inform you that the use of certain services on our website requires that you provide certain personal data through registration forms or by sending email messages, and that these will be processed and incorporated into files owned and controlled by DSG, S.L.

We also inform you that all our files are legally registered in the Personal Data General Registry of the Spanish Data Protection Agency.

Your email is the data that we’ll require you and it will only be used to grant you access and communicate with the “Landscape Monitor” software and to keep you informed on whatever information regarding its use that we consider of relevance to you.

The person to whom the details refer has the right at any moment to access the file and may rectify, delete or object to use of the data in accordance with data protection legislation. The User’s consent to process and cede personal details may be revoked at any time, without retroactive effect, in accordance with Articles 6 and 11 of Organic Law 15/1999 of 13 December on Personal Data Protection (LOPD).

The voluntary submission of personal information constitutes explicit consent to the treatment of the same and its incorporation into our files, albeit revocable, without retroactive effect, and the acceptance of the handling conditions expressed below.

If you have provided us personal information about a third party or provide it to us in the future you must have informed said party of the stipulations herein and received approval prior to providing the data.

In order to keep your personal information up-to-date, you must inform us of any changes. Otherwise, we will not be liable for the accuracy of the data on record.

The data we request are appropriate, relevant and strictly necessary for the purposes for which they are collected, and under no circumstances are you forced to provide them. All information requested in our forms must be provided to comply with the purpose of the request, except for forms marking required fields with an asterisk (*). You also certify that all information you provide is true, accurate and relevant to the purpose for which it is being requested.

Changes to Privacy Policy

As the Landscape Monitor software changes, we may update this Privacy Policy to keep up with new features and legislation. We advise you to periodically review this Policy to be informed about changes and their effective date. If the law requires your explicit consent, we will ask you for it. Otherwise, your continued used of the software will mean that you agree and consent to these changes. If you disagree with the changes and you do not want to operate within the updated Privacy Policy, you will need to stop using the service. Yet, we will always maintain our commitment to respecting your privacy.

Information Collection and Use

We collect your email address and password to create your account, give you access, support it, and communicate with you as part of the service. We also collect image and other personal information such as job title if you choose to upload it in your profile. The information is also available for other users in your landscape to interact with you. We also collect time, language and geographic areas associated with the location of the devices when you use our service as well as how you are accessing and using our services. We use this information to better understand how our service is used, improve it, and to comply with legal restrictions that may apply. When using our paid services, we collect name, address, and payment information to communicate on billing-related issues. We also maintain a record of how you have used external sources (feed service) to provide you with additional more targeted sources. This information is also used to communicate with you for support and administrative purposes. These communications are considered part of the service and youwill not be able to opt-out. In addition, we will use it to inform you about new services and offers unless you opt-out.

If you have been invited to a team, the data that you upload into the service such as, but not only, topics, comments, and votes belongs to the customer that invited you, whether your employer, another organization, or an individual. The customer is the person or organization paying for the service, otherwise, you are a user of the service. For Basic service, the data belongs to all the members of a Landscape community. As a customer, you grant us permission to access this data for the purpose of providing and improving our service and generating aggregate statistics, trends, and research. We might also access your data for service, technical or security issues as well as for customer support.

When, as a customer or user of our Basic service, you set up a new landscape, we record the name of your landscape. For details on how to create a new landscape, click here. When using our paid services, we collect name, address, and payment information to communicate on billing-related issues. We share this information with our third party payment companies.

We use cookies, tracking pixels and similar software as described in our Cookies Policy. These technologies give us information to provide you with a better service.

We may contact you from time to time to inform you about changes in our service and offers of our services that we think can be beneficial to you. Your acceptance of this Privacy Policy indicates your acceptance of this communication.

This information can also be used to send you special offers related to the service, unless you opt-out. It will not be made available to other companies unrelated to Landscape Monitor.

Information Disclosure

We need to share you information with partners that supply services required to offer you the best service. Beyond these partners, we do not share your personal information with any company or organization. Thus, we do not give or communicate your information to third parties, except as provided by law, and to entities directly related to the services you have purchased. We do have access to your contact information and the information that you post on the service. This access allows us to monitor the use of the service and improve it as well as confirm that it is used according to our Terms and Conditions. We will not disclose your personal information beyond your community. Any other communication will use aggregate statistics across users and landscapes. Our software analyzes your data routinely to empower services such as search or targeted feed.

Data Storage and Communication

When you device syncs with our service, your data is stored in our servers located in Spain. Thus, your personal and content information will be transferred to servers in Spain. Whenever you use our service, you consent to this information being hosted and accessed in Spain. Because security is important, ourselves and our suppliers take all reasonable technical and organizational precautions to protect the data during transmission and at the servers. However, the user needs to be aware that security is not infallible or foolproof; we cannot insure full data security. So, we shall not be liable for such situations and its consequences. You acknowledge that you use our service at your own risk.

If you decide to stop using our service, no more of your information will be stored in the system; however, past information will be stored in our backups.
